PRIVACY POLICY AND USE OF COOKIES ON THE WWW.TECHPOL.INFO.PL WEBSITE

§ 1. General Provisions

  1. The Privacy Policy and Cookies Policy for the website www.proform.eu (hereinafter: the “Policy”) has been created and adopted by Techpol Global sp. z o.o.
  2. The terms used in the Policy shall mean:
    1. Website – the website www.techpol.info.pl;

    2. User – an entity using the publicly available Website;

    3. Owner – Techpol Global sp. z o.o.;

    4. Cookies – text files sent by the Website and stored on the User’s end device used when browsing websites. These files contain information necessary for the proper functioning of the Website. Cookies typically contain the name of the website domain from which they originate, the duration of their storage on the end device, and a unique number.

  3. The purpose of the Policy is, in particular, to:
    1. provide Users with information on the use of Cookies on the Website, as required by applicable law, including the Polish Telecommunications Law;

    2. ensure the protection of Users’ privacy in accordance with the standards and requirements set out in applicable legal provisions.

  4. The Owner limits the collection and use of information concerning Users to the minimum necessary to provide services to them.
  5. In order to obtain full access to the content and services offered by the Owner via the Website, it is recommended that Users accept the rules resulting from this Policy.
  6. The following legal acts apply in particular:
    1. the Act of 16 July 2004 – Telecommunications Law (Journal of Laws 2017, item 1907, as amended);

    2. the Act of 18 July 2002 on the Provision of Electronic Services (Journal of Laws 2017, item 1219, as amended);

    3. Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation – GDPR) (OJ L 119, 4.5.2016), together with Polish data protection regulations.

 

§ 2. Protection of Privacy and Personal Data

  1. Data concerning Users are processed by the Owner in accordance with applicable law. Personal data obtained by the Owner are processed on the basis of the User’s consent or another legal ground permitting data processing under applicable regulations, in particular the GDPR.
  2. The Owner exercises special care to protect the interests of data subjects and, in particular, ensures that personal data are:
    1. processed lawfully, fairly, and in a transparent manner for Customers and other data subjects;

    2. collected for specified, explicit, and legally justified purposes and not further processed in a manner incompatible with those purposes;

    3. adequate, relevant, and limited to what is necessary for the purposes for which they are processed;

    4. accurate and, where necessary, kept up to date;

    5. stored in a form permitting identification of data subjects for no longer than is necessary for the purposes for which the data are processed;

    6. processed in a manner ensuring appropriate security of personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction, or damage, using appropriate technical or organizational measures.

  3. The Owner applies appropriate technical and organizational measures to ensure the protection of processed personal data, taking into account the nature, scope, context, and purposes of processing, as well as the risk of infringement of the rights or freedoms of natural persons.
  4. The Owner seeks to continuously modernize the IT, technical, and organizational measures used to protect personal data, in particular by ensuring updates to IT security measures protecting against viruses, unauthorized access, and other threats arising from the operation of IT systems and telecommunications networks.
  5. Each User who has provided personal data to the Owner in any manner is granted access to their data and the exercise of other rights of data subjects in accordance with applicable law, including the right to:
    1. withdraw consent to the processing of personal data;

    2. obtain information about their personal data;

    3. control the processing of data, including supplementation, updating, rectification, and erasure;

    4. object to processing or request restriction of processing;

    5. lodge a complaint with the supervisory authority and use other legal remedies to protect their rights.

  6. The Owner may process personal data in an automated manner, including profiling, in accordance with the GDPR. In such cases, the purposes of processing include marketing activities or the personalization of communications sent to Users (including tailoring information to Users’ needs or expectations). The User has the right to object to such processing by sending a message to the Owner at: finansowy@techpol.info.pl.
  7. Any person with access to personal data processes such data solely on the basis of authorization granted by the Owner or under a personal data processing agreement and only upon the Owner’s instructions.

 

§ 3. Cookies

  1. Cookies identify the User, allowing the Website content to be tailored to the User’s needs. By remembering preferences, Cookies enable the appropriate adjustment of content delivered to the User, including advertising content. The Owner uses Cookies to ensure an appropriate level of convenience of the Website, and collected data are used exclusively within the company for optimization purposes.
  2. Cookies are used for the purpose of:
    1. adjusting the Website content to the User’s preferences;

    2. optimizing the use of the Website, in particular by recognizing the User’s end device;

    3. generating statistics;

    4. maintaining the User’s session;

    5. delivering advertising content to the User.

  3. Cookies may be placed on the User’s end device.
  4. Collected data are used to monitor and analyze how Users use the Website in order to improve its operation and ensure more efficient and seamless navigation.
  5. It should be noted that in certain cases, independent of the Owner, software installed by the User on their end device for browsing websites (e.g. an internet browser) may by default allow Cookies to be stored on the User’s end device. Users may change Cookie settings at any time. These settings may be changed, for example, to block the automatic handling of Cookies or to notify the User each time Cookies are placed on their end device. Detailed information is available in the settings and instructions of the relevant software (internet browser).
  6. The User may at any time disable or restore the option of collecting Cookies by changing browser settings.
  7. Changing settings constitutes an objection, which may in the future result in difficulties in using the Website. Completely disabling Cookies does not prevent browsing content available on the Website, except for content that requires logging in.
  8. Failure to change settings means that data will be placed on the User’s end device (use of the Website will result in Cookies being automatically placed on the User’s end device).
  9. Data stored on the User’s end device do not cause configuration changes to the User’s device or to the software installed on that device.
  10. Information regarding Cookies also applies to other similar technologies used within the Website.

 

§ 4. Final Provisions

  1. The Policy has been adopted by order of the Owner and enters into force on the date of its adoption. Amendments to the Policy may be made in the same manner.
  2. Any deviations from the Policy require written form under pain of nullity.
  3. The law applicable to the Policy is the law of the Republic of Poland.
  4. In matters not regulated by the Policy, the relevant provisions of law shall apply.
